BY BROWSING, ACCESSING OR USING ANY OF THE TRAVR PLATFORM AND SERVICES, YOU AGREE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF USE. IF YOU DISAGREE WITH ANY OF THESE TERMS OF USE, PLEASE UNDERSTAND YOU CANNOT USE ANY OF THE TRAVR PLATFORM AND SERVICES. WE RESERVE THE RIGHT TO AMEND THESE TERMS OF USE AT ANY TIME. IF YOU DISAGREE WITH ANY OF THESE TERMS OF USE, YOU MUST IMMEDIATELY DISCONTINUE YOUR ACCESS TO TRAVR PLATFORM AND SERVICE. CONTINUED USE OF THE TRAVR PLATFORM AND SERVICE WILL CONSTITUTE ACCEPTANCE OF THESE TERMS OF USE, AS MAY BE AMENDED FROM TIME TO TIME.
1. Your Relationship with TraVR
1.1 These Terms of Use govern your use of the TraVR platform and service (www.travrhk.com) and any other online or offline services provided by us, as well as to govern your consumer activities in all booking experience through TraVR (collectively referred to as the “TraVR Service”).
1.2 These Terms of Use will constitute a valid contract between you and TraVR. While using any of the TraVR Services, you consent to be bound by any and all additional terms and conditions, as may be updated from time to time, applicable to such services and TraVR’s “Privacy Policy.” All such terms mentioned are hereby incorporated into these Terms of Use.
1.3 In the event that relevant laws require or TraVR deems necessary, TraVR may amend or update these Terms of Use at any time without prior notice to you. If there is any change in these Terms of Use, we will post the latest version of these Terms of Use on our website (www.travrhk.com) and we will indicate the date on which these Terms of Use were last updated. Your continued use of the TraVR Services after an update to these Terms of Use constitutes your acceptance of the updated version. Please check the latest version of these Terms of Use when you use the TraVR Services at any time.
2. The TraVR Service
2.1 The TraVR Services provides you an convenient and smart way to select and purchase tourism products, tickets and other experience related services supplied by TraVR or our third party suppliers (“Suppliers”) through the TraVR Platform. To the fullest extent permitted by law, you also agree that we may change, suspend, discontinue or terminate any services at any time and may impose regulations or restrictions on, or amend the terms of certain services, or limit your access to any part or all of the services, without prior notice to you.
2.2 You may incur fees and expenses which shall be paid to the Suppliers by you through your use of the TraVR Services. In addition, you may be subject to the terms and conditions imposed by the Suppliers. You acknowledge and agree that you are solely responsible for all such fees and expenses, and you agree to pay all such fees and expense and abide by all such terms and conditions imposed by the Suppliers.
2.3 We will make effort to maintain the operation of the TraVR Services and the TraVR Platform, but we do not warrant that the TraVR Services and the TraVR Platform will always function properly or stay uninterrupted by external factors. You agree that we reserve the right to reject your visit to the TraVR Platform or your use of the TraVR Services, and you also agree that we reserve the right to change, suspend, discontinue or terminate the TraVR Services or the TraVR Platform.
3. The Platform Content
3.1 The term “Platform Content” used in these Terms of Use refers to all the materials presented or used on the TraVR Platform by us, including but not limited to text, photographs, graphics, images, illustrations, video, audio, data, code and other materials. You acknowledge and agree that all of the Platform Content is the proprietary property of TraVR or the licensors who license TraVR to use such materials, which are protected by the relevant intellectual property laws. TraVR may change, modify or remove any Platform Content without prior notice to you.
3.2 Subject to your compliance with these Terms of Use, we hereby agree to grant you a limited, non-exclusive, non-transferable license to use or access the TraVR Platform, and we may revoke this license at any time without prior notice to you. You agree to comply with relevant intellectual property laws and other applicable laws and regulations, and solely use and access the Platform Content for personal, non-commercial, entertaining purpose. You promise that, in no event will you use, reproduce, translate, transmit, broadcast, sell, assign, create derivative works based on or in any other way exploit the Platform Content in a way that harms TraVR or the licensors who license TraVR to use such materials. You also undertake not to massively copy, save or download any Platform Content in any form. In addition, you agree that you will bear all risks arising out of your use or access to any Platform Content. To the fullest extent permitted by law, we are not liable in any way for any Platform Content, including but not limited to any errors or omissions in the Platform Content. You shall be solely liable for any losses or damages suffered by any person as a result of your use or access to the Platform Content.
4. Privacy Policy
For TraVR’s policy relating to its use of of your personal data, please review TraVR’s current Privacy Policy, which is hereby incorporated by reference to this Terms of Use. Your acceptance of this Terms of Use constitutes your acceptance and agreement to be bound by our Privacy Policy.
5. Terms of use for Your Information
5.1 You agree to indemnify and to hold harmless TraVR (and its officials, directors, agents, subsidiaries, joint ventures, employees, and third-party service providers) from and against any and all claims, damages, losses, liabilities and expenses, including reasonable attorneys’ fees, arising out of , involving, or in connection with, any breach of the Terms of Use or any laws by you.
5.2 You grant TraVR a permanent, irrevocable, royalty-free, transferable right and license to use the Contents worldwide which shall include but not limit to copy, modify, completely delete, adapt, publish, translate, create derivative works from, sell, distribute and / or incorporate the Contents into any form, media, or technology.
5.3 By submitting your email address with your Contents, you agree that TraVR and its third-party service providers are entitled to use your email address to communicate with you regarding the status of your Contents or for any other administrative purposes.
6. Your Undertakings
6.1 You shall use the TraVR Services and the TraVR Platform fully and only in accordance with these Terms of Use; you shall be solely responsible for all your behaviors while using the TraVR Services and the TraVR Platform.
6.2 You shall promise the following:
a) You agree not to copy, reproduce, distribute, publish, display, perform, transmit or broadcast any part of the TraVR Services without our prior written authorization, including, by way of example and not limitation, by doing or engaging in any of the following without our prior express written consent: (i) altering, defacing, mutilating or otherwise bypassing any approved software through which the TraVR Services are made available; and (ii) using any trademarks, service marks, design marks, photographs or other content belonging to TraVR or obtained from the TraVR Services.
b) You agree not to use, display, mirror, frame or utilize framing techniques to disclose the TraVR Services, including any service content available on or through the TraVR Services, or any portion thereof, through any other application or website, unless and solely to the extent we make available the means for embedding any part of the TraVR Services or service content.
c) You agree not to solicit, or attempt to solicit, personal information from other users.
d) You agree not to restrict, discourage or inhibit any person from using the TraVR Services, disclose personal information about a third person on the TraVR Services or obtained from the TraVR Services without the consent of such person, or collect information about our users.
e) You agree not to use the TraVR Services to communicate or facilitate any commercial advertisement or solicitation, except as expressly permitted in these Terms of Use.
f) You agree not to engage in any fraud, breach of the information security of the TraVR Platform, crack the passwords of other users, transfer or illegally save the data or engage in any other illegal activities.
7. Order Confirmation and Refund Policy
7.1 You can select and purchase tourism products, tickets and other experience related services provided by TraVR or the Supplier through the TraVR Platform. Except for certain orders which will be confirmed immediately after you place your order, other orders must be confirmed by TraVR or the Supplier afterwards. You agree to receive notification of successful bookings/orders via SMS or email, and you acknowledge and agree that the time it takes to reply the result of your bookings/orders as indicated on the TraVR Platform is for reference only. You also agree that the time it takes to confirm the success of your bookings/orders may be adjusted based on the actual situation.
7.2 TraVR reserves the right to change or adjust the prices and fees of tourism products, tickets and other experience related services provided by TraVR or the Supplier at any time. These changes may be announced via SMS, email and the website. If you use the TraVR Services after the notice of such changes, it means you agree and accept the changed prices and fees.
7.3 You agree that TraVR may, at our sole discretion, refuse or cancel any booking or order that may violate these Terms of Use.
7.4 In the case that the service you selected and purchased is provided by a Supplier instead of TraVR, such Supplier will accept or reject your booking/order on its own, and be responsible for providing all related services. If you have any questions about the content of the service provided by the Supplier, you may first ask the Supplier to obtain the most direct information.
7.5 You acknowledge and agree that the specific service provided by any Supplier may result in additional taxes or fees and expenses depending on the actual situation, and you may also be obligated to pay the relevant amount directly to the Supplier or the tax authority. Although we have requested the Supplier to provide the latest and accurate conditions of use, restrictions, prices and other information with respect to the services they provided, TraVR cannot warrant that all content displayed on the TraVR Platform will be accurate at all times.
8. Limitation of Liability
8.1 You understand that the Platform Content may be provided by the Supplier and agree that we do not provide any representation or warranty regarding the accuracy of the Platform Content. You agree that you will not ask TraVR to be responsible for any Platform Content provided by the Supplier in the future.
8.2 You agree that any contact or content transmitted with the TraVR Platform is not confidential, and that your communications or information disclosed may be read or used by Supplier and relevant parties. You acknowledge and confirm that there is no confidential, trust or other cooperative legal relationship created between you and TraVR.
8.3 To the fullest extent permitted by law, you agree that TraVR and our directors, senior managers, officers, employees and agents of such personnel are not responsible for any of your direct, indirect, special, incidental, punitive, exemplary or derivative damages arising out of their non-compliance of these Terms of Use and their use of the TraVR Platform or other acts of negligence.
8.4 To the fullest extent permitted by law, you agree that if you are not satisfied with the TraVR Services, your sole remedy is to stop using the TraVR Services.
9. Third-Party Websites and Transactions
9.1 The TraVR Platform may include external links to third-party websites or applications. You are responsible for evaluating whether you want to access or use them. We are not responsible for and do not endorse any features, content, products, or other materials on other websites or applications. You shall evaluate on your own and assume all risks.
9.2 If you connect to a third-party website or application through the TraVR Platform and have any transaction with such third party, you shall conduct an investigation that you deem necessary or appropriate. Such transaction is between you and such third party, and has nothing to do with TraVR. You acknowledge and agree that we are not responsible for any costs, losses or damages arising out of your transaction with such third party.
10. Termination
These Terms of Use will apply to you and TraVR until TraVR terminates these Terms of Use. In the event that you violate any provision of these Terms of Use or TraVR deems necessary at our sole discretion, we may terminate or suspend your use of the TraVR Services without any prior notice to you.
11. Visa and Insurance
11.1 When you purchase or book any travel related products and/or services, regardless of your nationality and destination, you shall check the now effective entry regulations of your destination on your own. Since the visa and health requirements in different countries may be subject to changes without any notice, we recommend that you double-check the relevant current regulations prior to your departure.
11.2 For your own rights and benefits, we recommend that you purchase a comprehensive travel insurance policy prior to your departure.

當你開始使用TraVR的平台及服務時，即表示你已閱讀、瞭解並同意接受本使用條款。如果你不同意接受本使用條款，即無法使用TraVR的服務。TraVR有權更新、修訂或修正本《使用條款》的條款或任何部分，且無須發出事前通知，若你繼續使用TraVR平台或其服務，即表示你接受更新、修訂或修正的《使用條款》。若你不同意本《使用條款》的所有條款與條件，及／或日後更新、修訂或修正的內容，你必須停止瀏覽或以其他方式使用TraVR平台及服務。
1. 你與TraVR的關係
1.1 本使用條款是用來規範你如何使用「TraVR虛擬旅遊體驗平台」(www.travrhk.com)及其他任何由我們提供的線上或線下服務，以及用來規範你透過TraVR所進行的預訂及服務使用行為（統稱「TraVR的服務」）。
1.2 本使用條款將構成你與TraVR之間的有效契約。在使用TraVR的服務時，你應接受任何不定時更新的所有與服務相關的額外條款約束，及TraVR的《私隱政策》，所有此等條款被提及時，均被納入至本使用條款。
1.3 基於相關法令的要求或如果我們認為有必要時，TraVR得隨時修改或更新本使用條款，無須事先通知你。當本使用條款有任何變更，我們會將最新版本的本使用條款公布在我們的網站(www.travrhk.com)，並且會標示最近一次更新的日期。如果你在本使用條款更新後繼續使用TraVR的服務，即代表你已同意更新後的本使用條款。請你使用TraVR的服務時，隨時參閱最新版本的本使用條款。
2. TraVR的服務
2.1 TraVR的服務是提供你可以透過TraVR平台，以輕鬆、簡易的方式選購TraVR或與我們合作的第三方供應商（「供應商」）所提供的產品、票券、旅遊及其他體驗服務。在法律允許的最大範圍內，你也同意我們有權不定期更改、暫停或終止任何服務，亦有權對個別服務加上規範、限制或修訂條款，或限制你使用部分或全部的服務，而無須事先通知你。
2.2 你可能因為使用TraVR的服務而須對供應商支付費用，你也會被要求遵守供應商的服務約款。你瞭解也同意你對於這些費用須負全部的責任，且也同意支付這些費用，以及遵守他們的服務約款。
2.3 我們將盡可能努力維持TraVR的服務與TraVR平台的運作，但是我們不保證TraVR的服務與TraVR平台能隨時正常運作或不受外在因素影響。你同意我們有權拒絕你瀏覽TraVR平台或使用TraVR的服務的權利，你也同意我們有權變更、暫停、中斷或終止TraVR的服務或網站或TraVR平台。
3. 平台內容
3.1 本使用條款所提到的「平台內容」，是指由我們呈現或使用在TraVR平台上的一切素材，包括但不限於文字、照片、圖像、影像、插圖、影片、音效、數據、程式碼及其他素材。你瞭解並同意所有的平台內容均屬於TraVR或授權TraVR使用之人的專屬財產，受到相關智慧財產權法的保護；TraVR就任何的平台內容，有隨時變更、修改或移除的權利，而無須事前通知你。
3.2 在你遵守本使用條款的前提下，我們同意授權你有限制、非專屬、不可轉讓使用或存取TraVR平台，我們可隨時撤回此一授權，而無須事前通知你。你同意遵守智慧財產權相關法律及其他適用的法律規範，僅得將平台內容用於個人、非商業性、娛樂性用途的使用或存取，在任何情況下，你承諾均不會以侵害TraVR或授權TraVR使用之人的方式，對任何的平台內容進行使用、重製、翻譯、傳輸、傳播、出售、轉讓、以之為基礎創造衍生著作，或以其他任何方式加以使用，你也不得以任何形式大量複製、儲存或下載任何的平台內容。此外，你同意你會對使用或存取任何的平台內容自行承擔風險，在法律允許的最大範圍內，我們不就平台內容對你負責，包括但不限於平台內容的錯誤或疏漏。如果任何人因為你的使用或存取平台內容的行為，而產生任何損害或損失，必須由你個人單獨承擔相關賠償責任。
4. 隱私保護政策
關於TraVR使用你個人資料的相關政策，請閱讀本公司現行有效的《私隱政策》，此等政策已納入本《使用條款》。當你接受本《使用條款》，即表示你同意《私隱政策》，且同意受此等政策所約束。
5. 你提供的資料
5.1 你同意並授權我們得依據TraVR的《私隱政策》使用你的個人資料。
5.2 你保證你提供的所有資料（包括但不限於文字、照片、圖像及影片等）未違反任何法律規範，未侵害任何第三人的權利，且TraVR使用該等資料不會侵害任何第三人的權利；你明瞭你必須對你提供的所有資料獨自負責，TraVR不對其中的任何錯誤或疏漏負任何責任
5.3 若你提供你的電子郵件地址與本平台，即代表你同意TraVR及其第三方服務提供商有權使用你的電子郵件地址與你就相關查詢及預訂內容，或任何其他管理目的與你進行通訊。
6. 你的承諾
6.1 你應完全並僅能依照本使用條款使用TraVR的服務或TraVR平台；你應就你使用TraVR的服務或TraVR平台的所有行為，單獨負擔法律責任。
6.2 你應承諾下列事項：
a) 未經我們的事前書面授權，你不得抄襲、重製、散布、公開發表、展示、傳送或公開播送TraVR的服務的任何部份，包括但不限於以下任何未經我們事前明確同意之行為：(i) 改變、毀損或規避任何TraVR的服務所使用的授權軟體；及 (ii) 使用屬於我們或從TraVR的服務取得的任何商標、服務標章、設計標章、照片或其他內容。
b) 除非我們開放TraVR的服務或服務內容的嵌入方法，否則你不得透過其他應用程式或網站，使用、展示、模仿、設計或運用框架處理技術去揭露TraVR的服務（包括透過TraVR的服務可以取得的任何部分）。
c) 你不得向其他使用者收集或企圖收集其個人資料。
d) 你不得限制或禁止任何人使用TraVR的服務、未經第三人同意揭露TraVR的服務上或從TraVR的服務取得的第三人個人資料，或收集有關使用者的資料。
e) 除非本使用條款明示許可，否則你不得使用TraVR的服務聯絡或從事任何商業廣告或資料收集。
f) 你不會從事任何詐欺、違反TraVR平台資訊安全、破解的其他使用者的密碼、移轉或非法儲存資料或進行其他的非法活動。
7. 訂單確認及退費政策
7.1 透過TraVR平台，你可以選購TraVR或供應商所提供的所提供的產品、票券、旅遊及其他體驗服務。除部分訂單會於你下單後即時成立外，其他訂單須經TraVR或供應商確認後始成立。你同意透過簡訊或電子郵件接收預訂成功的通知，而且你瞭解並同意TraVR平台所述回覆訂購結果的時程僅供參考，你也同意我們向你確認預訂成功的時間，可能視實際情況而調整。
7.2 TraVR保留隨時變更或調整TraVR或供應商所提供的產品、票券、旅遊及其他體驗服務相關的價格及費用的權利，變更的內容可能透過簡訊、電子郵件、網站、公布，若你於該等變更的通知發出後使用TraVR的服務，即代表你同意並接受變更後的價格及費用。
7.3 你同意TraVR得依我們的判斷，拒絕或取消任何可能違反本使用條款的預訂或訂購。
7.4 在你選購的服務是由供應商提供而非TraVR提供的情況下，該服務的供應商會獨自接受或拒絕你的預訂或訂購，並負責提供所有相關的服務。如你對於供應商的服務內容有任何疑問，你可先向供應商詢問，以獲得最直接的資訊。
7.5 你瞭解並同意任何供應商向你提供的個別服務，可能視實際情形產生額外的稅負或費用，你也可能有義務直接向供應商或稅務主管機關支付相關款項。儘管我們已向供應商要求提供其所提供的服務最新且正確的使用條件及限制、價格等資訊，但TraVR無法保證TraVR平台顯示的所有內容於任何時候皆正確無誤。
8. 責任限制
8.1 你瞭解平台內容可能由供應商提供，並同意我們就平台內容不提供任何針對正確性的聲明或保證，你同意將來也不會要求我們就供應商提供的任何平台內容負責。
8.2 你同意你任何與TraVR平台往來或傳輸的內容不具有機密性，且你的通訊內容可能被供應商及相關人仕閱讀或使用。你瞭解並確認，你與我們之間未建立任何機密、信託或其他合作性質的法律關係。
8.3 在法律允許的最大範圍內，你同意TraVR及我們的董事、高階經理人、主管、員工及該等人員的代理人，就任何因其違反本使用條款、使用TraVR平台或其他疏失行為，對你所造成的任何直接、間接、特殊、附帶、懲罰性、懲戒性或衍生性的損害，均不負責。
8.4 在法律允許的最大範圍內，你同意，如果你對我們的服務有任何不滿意，你對我們唯一的救濟措施即為停止使用我們的服務。
9. 第三方網站與交易
9.1 你可能透過TraVR平台連結到第三方網站或服務。你應自行判斷是否要使用此類第三方網站或服務，我們就這些第三方網站或服務的特性、內容、產品或其他資訊，均不負任何責任。你應自行評估並承擔所有風險。
9.2 如果你透過TraVR平台連結到第三方網站或服務，而與該第三方有任何的交易，你應進行你認為需要或適當的調查，該等交易均為你與該第三方之間的關係，與我們無涉，你確認並同意我們不須為你就此等交易產生的任何費用、損失或損害負責。
10. 終止
本使用條款將繼續適用於你與TraVR之間，直至我們終止本使用條款為止。如果你違反本使用條款的任何規定，或依我們的判斷而認為有必要時，我們有權立即終止或暫停你使用TraVR的服務，而無須對你為任何事前通知。
11. 簽證及保險
11.1 當你涉及預訂或使用旅遊相關的產品及服務時，不論你的國籍與旅遊的目的地為何，你應自行瞭解目的地現行有效的入境規定。由於各國簽證及健檢的規定可能臨時變更，且無任何通知，我們建議你在出發旅遊前，再次確認相關現行規定。
11.2 為了你自身的權益，我們建議你在出發旅遊前購買綜合旅遊保險。
